This summary is here to help. The full text below is what governs.
Artistry Boutique (“Artistry Boutique”, “we”, “us”) runs artistryboutique.com, an online marketplace where independent Canadian artists sell their own work to buyers. Artistry Boutique is run by Chewie Media Inc., a company in British Columbia, Canada. You can reach us at hello@artistryboutique.com. GST/HST registration number: [GST/HST no. to come].
By using the site, you agree to these Terms, our Privacy Policy and our Cookie Policy. Artists also agree to the Artist Agreement and the Artist Guidelines.
Artistry Boutique provides the platform. Each artist is the seller of their own work. When you buy a piece, your contract of sale is with the artist, not with Artistry Boutique. The artist is responsible for the listing, its accuracy, the price, packing, shipping, returns and any sales tax they must charge on the sale. We are not a party to that sale, and we do not take ownership of any artwork.
We take 0% commission on artwork sales. Stripe’s card processing fee (2.9% + 30¢ for Canadian cards, more for international cards) is deducted from each sale before the artist is paid. Artists also pay us a membership fee.
You must be at least the age of majority in your province or territory to create an account or buy, or have a parent or guardian’s permission. Keep your login private. You are responsible for activity on your account. Give us accurate information and keep it up to date.
Artists ship directly to you. Each artist sets their own return policy, shown on their shop or listing. Our Shipping & Returns page sets the minimum protections that apply to every order, including damaged, lost and not-as-described items. Nothing in these Terms limits any right you have under consumer protection law in your province.
If you hire an artist for a commission or other service, the scope, price, timeline and payment are agreed between you and the artist. Artistry Boutique is not a party to that agreement. We recommend putting it in writing before work starts.
Payments on Artistry Boutique are processed by Stripe Payments Canada, Ltd. and its affiliates (“Stripe”). Artist payouts are made through Stripe Connect. By buying or selling, you also agree to the Stripe Services Agreement (and, for artists, the Stripe Connected Account Agreement). Stripe’s own privacy policy applies to the payment details you give Stripe.
Listings labelled “Indigenous-made” must meet our Indigenous-made labelling policy. Misrepresenting work as Indigenous-made is prohibited, can mislead buyers, and may lead to removal of the listing and the account.
Mature artwork (for example nudity) is allowed but must be flagged by the artist. Flagged work is blurred until a visitor chooses to view it. Sexually explicit material, content involving minors, and illegal content are not allowed. See the Artist Guidelines.
Reviews must be honest, based on a real purchase, and free of abuse or personal information. Artists may not offer incentives for reviews or post reviews of their own work. We may remove reviews that break these rules.
Don’t list work that isn’t yours, infringe anyone’s rights, post illegal, hateful or harassing content, mislead buyers about a piece (condition, edition size, origin, materials), or try to hack, scrape or disrupt the site. We may remove content, suspend or close accounts that break these Terms.
Artists are free to sell their work and take commissions anywhere, including on their own website, at markets and by email. We ask one reasonable thing: if a buyer first contacted an artist through an Artistry Boutique listing or message about a specific piece, that purchase should be completed through the site. This keeps the buyer protected and the site sustainable. It doesn’t cover later or unrelated work with that buyer.
Please contact the artist first through their shop. If you can’t resolve it within 7 days, email hello@artistryboutique.com with your order number. We will review both sides and may, at our discretion, help mediate, remove listings or restrict an account. Card disputes and chargebacks are handled under Stripe’s and your card issuer’s rules.
The site is provided “as is”. To the extent the law allows, Artistry Boutique is not liable for the artwork, its condition or delivery (these are the artist’s responsibility), or for indirect or consequential losses. Our total liability to you for any claim related to the site is limited to the greater of the fees you paid us in the 12 months before the claim and CA$100. Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited by law. If you’re a consumer, the consumer protection laws of your province still apply to you, and this section only applies as far as those laws allow.
We may update these Terms. We’ll change the “Last updated” date, and for significant changes we will email members at least 30 days before they take effect.
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If you are a consumer, you also keep the protection of the laws of the province where you live.
